1. Services
Detailer Ads ("we," "us") provides marketing services to detailing businesses ("you," "client"). Depending on the package you purchase, services may include:
- Meta (Facebook and Instagram) advertising campaign strategy, build, and ongoing management
- Ad creative: scripting and editing from footage you supply
- GoHighLevel CRM setup and follow-up automations
- Google Business Profile optimization
- Weekly optimization and performance reporting
The exact scope of your package is what was agreed on your setup call and reflected on your invoice or subscription. We may adjust our methods, tools, and tactics at our discretion so long as we continue delivering the agreed scope.
2. Fees & billing
Our management fees start at $997 per month. Packages that include a build phase carry a higher first-month fee, disclosed to you before you pay. Your exact price is the price shown at checkout and on your invoice.
- Recurring billing. Subscriptions bill automatically every month on the same calendar day as your first payment, to the payment method on file, until you cancel.
- Payment processing. Payments are handled by Stripe. You authorize us to charge your payment method for all fees as they come due.
- Failed payments. If a payment fails, we may retry it. If payment is not resolved within 5 days, we may pause your campaigns until the balance clears.
- Price changes. We will give you at least 30 days' written notice before changing your recurring rate. If you don't accept the new rate, you may cancel under section 4.
- Taxes. Fees are exclusive of any applicable taxes, which are your responsibility.
There is no long-term contract on the monthly fee. Service is month-to-month.
3. Ad spend
Ad spend is separate from our management fee and is never paid to us. You pay Meta directly from your own ad account using your own payment method. We recommend a minimum of $20–30 per day.
You control your ad spend and are solely responsible for it. We are not responsible for charges Meta bills to your account, and we do not refund ad spend under any circumstances. If you reduce spend below the recommended minimum, campaign performance will suffer and any performance guarantee is void (see section 6).
4. Cancellation & the 24-hour notice requirement
You may cancel at any time. There is no cancellation fee and no minimum term on the monthly subscription. However:
How to cancel
- Email detailerads@gmail.com from the address on your account, or send written notice to the contact in section 22.
- Include your business name and state clearly that you are cancelling.
- Your cancellation is effective when we receive it, not when you send it. We recommend cancelling several days early rather than cutting it close.
- A verbal cancellation, a comment, or an unanswered DM is not written notice. Email is.
What happens after you cancel
- You keep full service through the end of the period you already paid for.
- We do not prorate or refund partial months.
- We will pause the campaigns we manage. You are responsible for turning off or reassigning anything in your own ad account.
- Your territory exclusivity ends immediately on cancellation and your city may be offered to another detailer.
5. Refunds
Management fees are non-refundable once charged, except where the performance guarantee in section 6 applies or where required by law. This includes, without limitation:
- Charges that process because you cancelled with less than 24 hours' notice
- Partial months after a mid-cycle cancellation
- Periods during which you chose not to use the service, did not respond to leads, or paused your own ad spend
- Build or setup fees, once the build work has begun
- Ad spend of any kind (that money went to Meta, not to us)
Approved refunds are returned to the original payment method and typically post within 5–10 business days.
6. Performance guarantee
Where we have advertised a bookings guarantee (10 bookings in 30 days or we work for free), it applies from the date your campaign goes live and is conditional on you meeting every one of the following:
- You maintain the recommended ad spend of at least $20–30 per day, uninterrupted, for the full 30 days
- You respond to inbound leads within a reasonable time; our standard is 5 minutes during business hours
- You attend your setup call and supply the creative footage we request
- You do not pause, edit, or restructure the campaigns we manage without our agreement
- Your account remains in good standing with all fees paid
- You claim the guarantee in writing within 14 days of the end of the 30-day period
"We work for free" means we continue managing your campaigns at no management fee until the 10-booking threshold is met. It is a service remedy, not an automatic cash refund. If you do not meet the conditions above, the guarantee does not apply.
7. Territory exclusivity
While you are an active paying client in good standing, we will not take on a directly competing detailing business in your defined service area. Your territory is defined on your setup call. Exclusivity ends immediately if your subscription lapses, is cancelled, or is terminated.
8. Your obligations
Our work only produces results if you hold up your side. You agree to:
- Respond to leads promptly and be genuinely available to take on the work we generate
- Maintain your ad spend at the agreed level
- Provide timely access, footage, approvals, and information we reasonably request
- Operate a legitimate, properly licensed and insured detailing business
- Ensure everything you give us (photos, video, testimonials, claims about your business) is accurate and yours to use
- Comply with Meta's advertising policies and all applicable law
If you don't meet these obligations, we can't guarantee results, and any performance guarantee is void.
9. Creative & ownership
You retain ownership of the raw footage, logos, and brand assets you supply. We retain ownership of our templates, frameworks, campaign structures, and internal processes.
Ad creative we produce for you is licensed to you for use in your own marketing for as long as your account is in good standing, and you may keep and continue using the finished creative after cancellation.
You grant us permission to reference your business name, results, and campaign performance in our own marketing and case studies. If you'd rather we didn't, email us and we'll honor that.
10. Accounts & access
To deliver the service you will grant us access to your Meta Business Manager, ad account, page, and any other platform required. You keep ownership of these accounts at all times. You are responsible for the security of your own credentials. We will only use access for the purpose of delivering your service, and we will not sell or share your business data with third parties beyond the platforms and tools required to run your campaigns.
11. Chargebacks
If you have a billing issue, contact us first. Most things get sorted the same day. Filing a chargeback or payment dispute for a charge that is valid under these terms is a breach of this agreement. We may respond to any dispute with your acceptance record, service logs, and campaign performance data, and we may suspend or terminate service and decline future business.
12. Termination by us
We may suspend or terminate your service, with notice where practical, if you fail to pay, breach these terms, ask us to run advertising that is false or unlawful, or behave abusively toward our team. If we terminate for convenience rather than for cause, we will refund the unused portion of the current billing period.
13. Third-party platforms
Our service depends on platforms we don't control: Meta, GoHighLevel, Google, Stripe, and others. Their policies, pricing, algorithms, approval decisions, and outages are outside our control. We are not liable for account restrictions, ad disapprovals, platform bans, cost increases, or service interruptions caused by these third parties. Your use of those platforms is also governed by their own terms.
14. Disclaimers & limitation of liability
No income guarantee. Results shown on our website, in testimonials, and in case studies are real results from specific clients. They are not a promise of what you will earn. Advertising results vary by market, season, pricing, service quality, competition, and how fast you respond to leads. Nothing on this site or in our materials is a guarantee of income or a specific number of jobs, except the limited performance guarantee in section 6.
Except for the guarantee in section 6, services are provided "as is" without warranties of any kind, express or implied.
To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to these terms or the services is limited to the total management fees you paid us in the three (3) months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost business opportunity, even if advised of the possibility.
Nothing in these terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Detailer Ads and its owners, employees, contractors, and agents from any third-party claims, losses, and reasonable costs or attorneys' fees arising out of: (i) your business, your services, and the work you perform for your customers; (ii) any photos, video, testimonials, offers, prices, or claims about your business that you provide or approve for use in your ads; (iii) your violation of these terms; or (iv) your violation of any law, regulation, or third-party right, including advertising, consumer protection, licensing, and privacy laws. We may assume control of the defense of any such claim at your expense, and you agree to cooperate with our defense. You agree not to settle any such claim without our prior written consent.
16. Confidentiality
Each of us may share non-public information with the other, such as your pricing, customer lists, lead data, and revenue, and our campaign structures, ad playbooks, templates, scripts, automations, and processes ("Confidential Information"). Each party will use the other's Confidential Information only to perform or receive the services, and will not disclose it to anyone except employees and contractors who need it for that purpose and are bound to keep it confidential.
This does not apply to information that is or becomes public through no fault of the receiving party, was already known to the receiving party, is independently developed, or is lawfully received from someone else without a duty of confidentiality. A party may disclose Confidential Information when required by law, after giving the other party reasonable notice where legally allowed. These obligations survive for two (2) years after our relationship ends. Our right to reference your results in section 9 is not limited by this section.
17. Events outside our control
Neither party is in breach for a delay or failure to perform (other than payment of money owed) caused by events beyond its reasonable control, including platform outages, ad account restrictions or policy changes by Meta or other platforms, internet or power failures, natural disasters, government action, or illness. The affected party will notify the other as soon as practical and resume performance as soon as it reasonably can.
18. Changes to these terms
We may update these terms from time to time. The "last updated" date at the top will change. Material changes affecting your billing, cancellation rights, or refund rights take effect no sooner than 30 days after we post them, and we will notify active clients by email. Continuing to use the service after that period means you accept the updated terms.
19. Dispute resolution & governing law
Governing law. These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and by the Federal Arbitration Act.
Talk to us first. Before starting any formal proceeding, the party raising a dispute must send written notice describing it to the other party (to us at detailerads@gmail.com). We will both try in good faith to resolve it informally, including by phone or video call. If it isn't resolved within 45 days of the notice, either party may start arbitration.
Binding individual arbitration. Except as described below, any dispute arising out of or relating to these terms or the services will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules (or its Comprehensive Rules for claims over $250,000). The arbitration will be held by video conference or in San Francisco County, California, unless the parties agree otherwise. The arbitrator may award the same individual relief a court could, and judgment on the award may be entered in any court with jurisdiction. Each party bears its own attorneys' fees unless the arbitrator finds a claim was frivolous or brought for an improper purpose.
Exceptions. Either party may (a) bring an individual claim in small claims court, including to collect unpaid fees, and (b) seek injunctive relief in court to protect its intellectual property or Confidential Information. Any claim not subject to arbitration will be brought in the state or federal courts located in San Francisco County, California, and both parties consent to that venue.
Jury trial and class action waiver. YOU AND DETAILER ADS EACH WAIVE THE RIGHT TO A TRIAL BY JURY. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. If a court finds this class action waiver unenforceable as to a specific claim, that claim will be heard in court, and all other claims remain subject to arbitration.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these terms by emailing detailerads@gmail.com with your name, business name, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these terms.
20. General
- Electronic acceptance. Checking a box, clicking to agree, submitting our onboarding form, or paying an invoice or subscription is your electronic signature and acceptance of these terms, with the same effect as a handwritten signature.
- Notices. We may give you notice by email to the address on your account or in your client channel. You consent to receive communications electronically, and they satisfy any requirement that notice be in writing. Notices to us must be emailed to detailerads@gmail.com.
- Independent contractors. We are an independent contractor. Nothing in these terms creates a partnership, joint venture, employment, or agency relationship, and neither party can bind the other.
- Assignment. You may not assign or transfer these terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of our business. These terms bind permitted successors.
- Survival. Sections on fees owed, refunds, creative & ownership, chargebacks, disclaimers & limitation of liability, indemnification, confidentiality, and dispute resolution survive the end of our relationship.
- No waiver; severability. Our failure to enforce a provision is not a waiver of it. If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the rest of these terms remain in full effect.
- Entire agreement. These terms, together with your invoice or subscription confirmation and our Privacy Policy, are the entire agreement between us and supersede any prior discussions or promises. "Including" means "including without limitation."
21. SMS messaging
The program. Detailer Ads operates an SMS messaging program for detailing business owners who apply to work with us. Messages we send include application updates, appointment scheduling and reminders, follow-ups on your inquiry, account and service notifications, and promotional messages about our services.
How you join. You join by entering your mobile number and checking the SMS consent box on our application form at detailerads.com/apply. That checkbox is optional and never pre-selected. Consent to receive text messages is not a condition of purchasing any goods or services: you can decline it and still apply and become a client.
Age requirement. You must be 18 years or older to consent to receive messages from us and to use our services.
Message frequency. Message frequency varies depending on where you are in the process. Most recipients receive no more than a few messages per month.
Cost. Message and data rates may apply. We do not charge you for text messages; your mobile carrier may charge you according to your plan.
How to stop. Text STOP to any message at any time to unsubscribe. You will receive a single confirmation that you have been unsubscribed, and no further messages after that. Text HELP for assistance, or contact us at detailerads@gmail.com.
How we handle the data behind this program (including our commitment that mobile opt-in data and consent are never shared with third parties) is described in our Privacy Policy.
